How Banning Sports Betting Undermines The Constitution

Though legal sports betting is prohibited in the US by Federal law, there has been in recent years a re-examination of its logic on a variety of levels. Part of this is a desire for new revenue sources, while part is simply a growing acceptance of gambling in all forms. Ultimately, the true injustice of banning sports betting lies in its contempt for the Constitution.

Unfortunately, the Congress of the United States has shown very little respect for the Constitution in recent years. Were it to abide strictly by the role outlined for it by the founding fathers, the Legislative Branch of our government would have to relinquish any number of its powers in a variety of areas. The primary problem with our Congress is that it has increasingly become a collection of career politicians rather than a body representative of its constituency. As a result, the overriding concern of the average Senator or Congressman is increasing the power that he is able to wield, and as a result the power that his body is able to bring to bear.

The Federal prohibition of sports wagering which was enacted a few years back is of very dubious Constitutionality. Were it not for the grandfather clause, which allowed it to remain legal in jurisdictions in which it already existed, it would have certainly been struck down as unconstitutional on a number of different fronts.

The mere fact that a proposed law or initiative is unconstitutional offers no protection for the citizenry. If a politician can suggest that a law is for ‘the children’ many will swallow the bait hook line and sinker. In many cases such prohibitive legislation contradicts one of the most important concepts in the Constitution–that of the right to sovereignty and self-determination of the individual states:

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

In other words, unless the power in question has been expressly given to the Federal government by the Constitution, and/or unless it has expressly been prohibited to the states (as in the case of treaty making) it is the right of each individual state to govern themselves as they see fit. If an individual state chooses not to regulate a certain activity, it is the right of each individual citizen to make their own decision. That was the overriding concern of the writers and framers of the Constitution”that the personal liberty of the individual not be violated by a too-powerful central government.

So, here exactly does the Constitution delegate to the Federal government the right to make policy on sports gambling? The answer is that it doesnt, and it is very questionable that they have the Constitutional authority to do so.

Sports gambling may seem a minimally important issue to some, but the erosion of liberty is an incremental danger. The danger to broader concepts of personal liberty may seem a million miles away, but with each additional law intended to protect us from this or that the Federal government becomes larger and more powerful and the rights of the sovereign states”and the individuals that comprise them”are shrinking and being weakened.

The NL Cy Young Picture

In just a few short days, the National League Cy Young winner will have been selected. The race could really go either way, and no one’s quite sure as to who will win it in the end.

There were some exceptional pitching performances in the National League in 2009. It can be argued that at least 4 or 5 pitchers would have won it hands down in seasons past had they had these seasons then. Some of the best pitchers this past season included the likes of Adam Wainwright, Jair Jurrjens, Clayton Kershaw, and Matt Cain. Not to mention many others.

At the end of the day though, the best pitching was hands down performed by Tim Lincecum, the young hurler with the San Francisco Giants, and Chris Carpenter, the veteran ace pitcher in St. Louis who came back from a two year hiatus that saw him sidelined with injury.

Looking at the stats doesn’t tell the whole story with either of these pitchers. That’s perhaps what makes this race even more difficult to call, as if it wasn’t already hard enough. It’s almost painful to deny either of these incredible pitchers of an award they deserve. Maybe they’ll somehow tie for the award.

Tim Lincecum brought the San Francisco Giants back into contention. A steady presence at starting pitcher through the entire season, his numbers were incredible. His low ERA was 2.48 was amongst the best in baseball, and he led all pitchers with 261 strikeouts.

On the other hand, Chris Carpenter’s story may be more interesting, and his numbers equally impressive. Carpenter sat out almost all of 2007 and 2008 due to injury. Now in his mid 30s, no one expected he’d be as dominant as he was in 2009. He had the best ERA in the National League at 2.24, and won 17 games while losing only four.

At the end of the day, this race could truly go either way. Carpenter had the better ERA and WHIP, but Lincecum’s strikeouts were insane. Carpenter does have the better story to tell, so my prediction would be that he wins.

Knowing The Time To Fold In Online Poker

To be a good poker player, you’re going to need to know when to fold your hands, and you may have a tough time learning just how to do so. Of course, most players think their hands are going to win, so they may not think about what their opponents are going to have, too.

Knowing when to fold is a strategy the best players have figured out. If you play Texas Hold’em, you have to analyze the cards that are in the center of the table and see what the possibilities are. If the “flop” is three suited cards, somebody could have a “flush”. If they are three consecutive cards, somebody could have a “straight”. If they are three of a kind, somebody could have a “full house” and so on.

If you don’t take a look at these possibilities and keep them in mind, it’s likely that you will lose. However, if you can make a hand on “the flop,” remember, too, that somebody else might be able to as well. Their hand could be of a higher value than yours is. With online casino games, remember that two straights are not equal. Instead, the player with the highest valued straight is going to win.

Online poker can also be somewhat difficult because the “kicker” card may determine who the winner is. A lot of players forget about this rule and they may lose their stash in online games, if that does happen. As one example, if you hold an Ace, Queen pair and another player holds an Ace, King pair, AND then the flop card gives a pair of aces, you’ll have a pair of aces and the other player will too. However, the other player is going to win because he has a “King” kicker, while you only have a “Queen” kicker.
